General Terms and Conditions
These General Terms and Conditions apply for the Hotel accommodation as well as all other services rendered to the guest and or booking party, hereafter Customer, by the Lord Elgin Hotel, hereafter Hotel.
2.1. Booking guarantee
In order to hold a room, Hotel may request a guarantee for the booking, including, but not limited to, credit card or deposit. A valid photo I.D, as well as credit card used to pay your deposit will be required at check-in. Minimum age to book the hotel is 18 years or older
2.2. Non-guaranteed bookings
Reservations not guaranteed with a method of payment may be released by Hotel without notice.
2.3. No-Shows and late cancellations
In the event of a no-show without prior notice or a cancellation after the deadline for free cancellations, a no-show or late cancellation fee in the amount of, unless otherwise specified, the first night, including HST and all other taxes and or fees will be charged to the method of payment indicated as the booking guarantee.
2.4. Booking modifications and cancellations
Unless otherwise specified, Customer may modify or cancel the booking free of charge until 3 pm two days prior to the original day of arrival.
2.5. Early departures
In the event of departure prior to the original date of departure, the Hotel reserves the right to charge the reservation in full.
2.6. Transfer of reservation
If, at the time of arrival, the reserved room is unavailable for any reason, the Hotel reserves the right, at its option, to relocate Customer to another room at a sister Hotel, if available, or, alternatively, to a comparable room in another location.
2.7. Pricing and offering errors
Without limitation, the Hotel reserves the right to cancel reservations or modify rates where any incorrect information has been displayed or provided in relation to a price or package advertised. This applies to any reservation and is subject to the cancellation policy outlined herein.
Should circumstances as outlined in 2.7 arise, Hotel will refund to Customer any deposit or the full cost of any prepaid advance booking made, via the original method used for payment.
2.8. Cancellation for reasons beyond the control of the Hotel
Without limitation, if, for reasons beyond the control of Hotel, including, but not limited to, acts of God, civil disorder, acts of war, strikes, or labour disputes, Hotel is unable to meet its obligations under any agreement, this will not amount to non-performance of any contract and Hotel may terminate its obligations hereunder without further liability of any nature to Customer.
Should circumstances as outlined in 2.8 arise, Hotel will refund to Customer any deposit or the full cost of any prepaid advance booking made, via the original method used for payment.
Unless otherwise indicated, payment will be due upon departure.
2.9.1. Payment authorization
Hotel reserves the right to pre-authorize Customer’s credit card prior to, and/or, upon arrival. This will put a hold on the funds required to settle the accommodation bill as well as a security deposit. Any unutilized hold will automatically released after departure.
Customer may check-in the room as of 3 pm on the day of arrival
Upon check-in, government-issued photo identification and a credit card deposit are required for incidental charges. The cardholder must be present and hold valid government-issued photo identification.
Customer is asked to vacate the room by 12.00 pm (noon) on the day of departure. A late departure may result in a late departure fee up to the amount of an additional night based on the Best Available Rate for the day.
3. Non-Smoking Policy
Hotel operates a strict non-smoking policy in its premises, including, but not limited to tobacco, cannabis for medical or recreational use, and e-cigarettes. Customer shall be liable for any costs, loss of earnings and/or profit or damage to a Hotel room, premises or property, arising from failure to comply with this policy and Hotel reserves the right to charge a specialist cleaning fee of $300 to any Customer who violates the non-smoking policy. Fee is subject to change.
4.1. Limitations to liability
In no event shall Hotel be liable for any special, indirect or consequential loss or damage arising out of any service provided or by failure to provide such services to Customer by Hotel or Customer’s access or use, or inability to use the Hotel’s website. Customer hereby waives any and all claims against Hotel howsoever arising.
4.2. Third parties
Without prejudice to the foregoing, Hotel will not be responsible for any additional and / or third party related costs paid by Customer in contemplation or in connection with any reservation, or incurred during your stay.
4.3. Links to third party websites
Links that feature on Hotel’s websites, emails and publications are links to other websites, which we believe may be of interest to you. By providing these links we are not endorsing or recommending such websites or the services or material provided by them. We therefore accept no responsibility for the materials, services or other situations at or related to or from any other website.
4.4. Maximum liability
Without prejudice to the foregoing, in no event shall the total liability of Hotel to Customer arising from these terms and conditions exceed the total cost of monies paid (or payable) by Customer to Hotel in connection with your reservation.
Nothing in these terms and conditions shall exclude or limit any liability of Hotel for fraud, death, personal injury, or any other liability which cannot be excluded by law.
Should individual provisions of these General Terms and Conditions be or become invalid or void, the validity of the remaining provisions shall not be affected thereby.
6. Pet Policy
The Lord Elgin Hotel is a pet-free facility. Should you have a pet in your room, a non-refundable cleaning fee of $300.00 plus HST will apply
